... in the 1840s & 1850s (!) a new legal philosophy took hold. No longer were private property rights upheld. An environmental plaintiff came to court under this new system...was told that his private property rights were being violated, but this was entirely proper...even more important than selfish, individualistic property rights...LONG AGO!
